Chapter 13  Bankruptcy Attorney | Chapter 13 Debt Relief Information.

David Casey, Attorney

365 Broadway, Suite 203

             El Cajon, California

                   (619) 447-6780

We are a debt relief agency. We help people file for relief under the Bankruptcy Code.

In the last 20 years I have helped hundreds of individuals like yourself with divorces and the financial problems that they can cause.  If you are having money problems after your divorce you are in the vast majority of divorce individuals, a Chapter 13 bankruptcy filing may be the answer for you.  It does not discharge your debt but in some cases it can be lowered to pennies on a dollar under a bankruptcy chapter 13 bankruptcy plan.  It could help you from getting your home out of foreclosure, stop repossession for taking place on your vehicles and it will certainly  stopping creditor's from harassing you.  As most people who has creditor problems will tell you a divorce can be messy but creditors just keep calling you all the time demanding payment.

The Law Office of David A. Casey provides provides personal service to our clients. If you have been through a divorce and you are in need of debt relief using Chapter 13, my office will give you professional legal representation.   Filing for bankruptcy is a major and important decision that will affect you financially.  Attorney Casey provides you with the time necessary to ensure that the bankruptcy process is done properly.  After a contested divorce, getting out of debt can be more of a challenge than the actual divorce.  Chapter 13 can help.   I can advise you what it can and can't do and whether or not  a Chapter 13 or Chapter 7 is right for you.

Attorney Casey's philosophy is to treat every client with respect as we would expect to be treated if there was a change of events that affected our lives.  The purpose of bankruptcy is to seek relief from your financial hardship, stop foreclosures,  and put a stop to unreasonable harassing creditors pursuant to the bankruptcy laws. For many Chapter 13 Bankruptcy is a legal procedure to get you back on track.  After a divorce just about everything might be upside down and a bankruptcy chapter payment plan may be the best option you have. Many times on unsecured debt you may only have to pay a small amount instead of the entire debt. Plus, if you complete the plan the remainder is discharged.

In Most Chapter 13 Bankruptcy filings my office doesn't require payment of attorney fees upfront.  Attorney fees are paid out of the plan to my office.  I also use the court presumed rate from attorney fees instead of billing rate unless otherwise indicated, and again, my fees are paid out of the Chapter 13 plan.  We are here to make this as easy as possible for you and most people after they file wonder why they waited so long to file a Chapter 13 under a wage earner plan.

In the last year, bankruptcy filings have increased 30%. The primary reason for filing personal bankruptcy is an unforeseen financial down turn, loss of savings and unable to borrow funds at a reasonable rate. Many have over time had medical expenses, excessive credit card debt, loss of employment, death of a family member and divorce.

California - Chapter 13 Bankruptcy Information

Many times you will hear Chapter 13 as a repayment  plan or a wage earner plan.  Many times after a divorce there is only a little amount of money left to pay on both secured debts and unsecured debt.  Chapter 13 can help many.  Under a Chapter 13 bankruptcy, the debtor  proposes a 3-5 year repayment plan to the creditors offering to pay off all or part of the debts from the debtor's future income. After reviewing all the facts I will tell you what is right for you.

Chapter 13 can be used to  prevent a house foreclosure; make up missed  or late trust or or mortgage payments; to stop or lower interest from accruing on you tax debt;  or pay back taxes; (local, California state taxes, or the IRS federal).  You can also keep non-exempt property which you would have been required to liquidate under  Chapter 7 but don't have to under Chapter 13.  If you finish the plan and make the payments under the terms of your repayment agreement, all your remaining dischargeable debt will be released at the end of the plan (typically three to five years). How much will you have to pay under  Chapter 13?  The amount to be repaid is determined by different legal  factors including the debtor's disposable income. Also the minimum total amount paid to creditors under the Chapter 13 plan must be at least the amount that the debtor would have paid the creditors.   Under  Chapter 13 bankruptcy protection you must have a "regular source of income" and this regular source of income must include  some disposable income to make payments under the Chapter 13 payment plan.

Chapter 13 bankruptcy is generally used mainly by debtors who have significant debts and are behind and also have secured assets and want to keep them. This can be a home, car, equipment where the debtor has  more equity in the secured assets than is allowed under bankruptcy exemptions.  Chapter 13 bankruptcy is a chance to reorganization your debt whereas a Chapterr7 bankruptcy is a liquidation of all but exempt assets.

Under a Chapter 13 bankruptcy, you are allowed to make up overdue payments over time and to reinstate the original agreement. You can keep valuable nonexempt property under a Chapter 13 plan.  In many cases, a  Chapter 13 can be a better option than a seven. However, if you want to eliminate your big heavy debt burden and don' want to make payment for 3-5 years then Chapter 7 is the way to go if you meet the means test.

After filing bankruptcy you have no outstanding debt and cannot file for another eight years. In fact, you look like a much better candidate for credit card companies after filing bankruptcy. You even have the money to pay the credit card amount each month without any interest charges.

Thinking about buying a home after chapter 7 bankruptcy? Studies indicated that around 90% of individuals after filing bankruptcy receive solicitation from a lender actually indicating that they knew they had filed bankruptcy. So remember, credit is your ability to borrow money, and that may actually improve after filing bankruptcy. Certainly it will improve if you can put money aside to pay your bills, on time, after the bankruptcy and probably to put some money into a savings account.  Bankruptcy is a right granted under the federal law to protect and to help people like you.
